Ogranak HNO “DESETI RUJNA 1976.” je bilo službeno ime organizacije Hrvatski Narodni Otpor.Poslije Akcije Zvonka Bušića i njegove petorke posudbe TWA zrakoplova 10 rujna 1976. godine, hrvatska iseljenička emigracije se je uzburkala i reklo bi se trgla se iz mrtvila i oživjela poslije ubojstva Maksa Luburića i mnogih drugih istaknutih hrvatskih političkih emigranata.

Dolje potpisani, koji su državljani Sjedinjenih Američkih Država, želeći stvoriti udruženje, neprofitnu organizaciju, prema zakonima države Kalifornije ovime potvrđuju:
PRVO: Da će ime spomenute organizacije biti AMERIČKI PRIJATELJI HRVATSKOG NARODNOG OTPORA,
DRUGO: Da će mjesto u ovoj državi u kojoj će biti glavni ured korporacije biti u gradu San Mateo,
TREĆE: Svrha ili svrhe zbog kojih je navedeno društvo osnovano su sljedeće:
a) Uzajamna pomoć članova;
b) Širenje hrvatskog bratstva među ljudima;
c) Promicanje narodnog, političkog, socijalnog, duhovnog i kulturnog postignuća među članovima;
d) Obrazovanje usmjereno na dobro i odano državljanstvo Sjedinjenih Američkih Država;
e) Borbu protiv komunističkih aktivnosti objavljivanjem i širenjem tiskanih materijala poput knjiga i brošura, materijalno i moralno podržati druge američke hrvatske antikomunističke organizacije u ovoj zemlji i drugdje;
f) Osnovati Hrvatski informativni centar u svrhu istraživanja i prikupljanja informacija o komunističkim aktivnostima, njihovoj propagandi među hrvatskim narodom u cilju djelovati protiv prodora komunističkih ideja u Američko-Hrvatske redove;
g) Dostavljati Sjedinjenim Američkim Državama informacije koje se odnose na borbu hrvatskog naroda;
h) Raditi na postizanju slobode i neovisnosti hrvatskog naroda rezolucijama, memorandumima , mirne demonstracije u okviru Ustava Sjedinjenih Država, države Kalifornije i drugih država i zakona Sjedinjenih Država.

Kada su federalne vlasti FBI u četvrtak jutro, u rane sate 25 lipnja 1981. godine uhapsile devet Hrvata članova organizacije HNO, u optužnici uz devet Hrvata je bila i organizacija HNO optužena kao organizacija zločinalkog udružanja. Deseti Hrvat je bio Drago Sudar iz Toronta. Javni tužitelj Stuart Baskin je optužio organizaciju HNO kao jednu ilegalnu organizaciju na području Amerike te istu stavio pod zakon RICO, Rackeetiring, Influence, Corrupt, Organization, što bi najblaže prevedeno na hrvatski jezik bilo: Urotnička, Djelotvorna, Pokvarena, Organizacija. Ovaj zakon RICO je došao na snagu 1962. godine, ili u to vrijeme kada su se Federalne vlasti Amerike borile protiv talijanske Mafije, jer je ista bila neslužbena i iligalna talijanska organizacija na području Amerike.
Kada sam ja mojem odvjetniku Dennis Roberts pokazao ove službene potvrde da je organizacija HNO službeno postala CROATIAN NATIONAL RESISTANCE NON PROFIT ORGANIZATION, prevedeno na hrvatski DOBROTVORNA ORGANIZACIJA HRVATSKOG NARODNOG OTPORA, HNO, on je to dao javnom tužitelju Stuart Baskin-u. Kad je ovaj to vidio, nevoljno i nezadovoljno je morao ukinuti optužbu protiv organizacije Hrvatski Narodn Otpor, te optužiti samo one pojedince ili članove organizacije Otpor koji su se ogriješili o američki zakon. U tu svrhu prepisujem ovdje iz THE NEW YORK TIMS, SUNDAY, MAY 16, 1982., šta i kako oni pišu o presudi Hrvata od subote 15 svibnja 1982., gdje otvoreno, službeno i javno pišu da Otpor nije bio optužen za nikakova krivična djela.
Ja ću ovo prepisati iz spomenutog The New York Times na engleskom jeziku. Usput bih zamolio neku Hrvaticu ili Hrvata koji dobro govore i hrvatski i engleski da ovo prevedu na hrvatski jezik. Hvala. Mile Boban, Otporaš.
6 CROATIANS CONVICTED OF RACKETEERING CONSPIRACY

Six Croatian nationalists accused of engaging in a conspiracy involving murder, arson and extortion were found guilty yesterday by a federal jury in manhattan. Four other defendants were acquitted.
During the trial, which lasted nearly tree months, the 10 men were portrayed by the defense as “patriots” persecuted by “the jugoslav secret police”. The prosecution denounced them as the leaders of a “criminal enterprise” that carried out many violent acts “in the name o Croatian Independence.” (Amerikanci ili američki vojnici u ime obrane slobode ili demokracije rade istu stvar u tuđim zemljama. Mi Hrvati smo u njihovoj zemlji smo im htjeli dokazati da mi nismo Jugoslaveni nego Hrvati. Njihovom službenom izjavom “U ime Neovisnosti Hrvatske” nema većeg i boljeg svjedočanstva od ovoga da se je HNO borio protiv Jugoslavije a za Neovisnost Države Hrvatske. Mo. Otporaš.)
The end of the trial come a little more than a year after four other Croatians were convicted on similar charges of conspiracy involving a plot to murder a political opponent and bomb buildings in New York. They drew sentences ranging from 20 to 35 years in prison. (Ovdje se radi o skupini Ivana čale, Franje Ivića, Stipe Ivkošića, Nede Sovulja i drugih. Mo. Otporaš.)
After deliberating for almost a week, (Two weeks. I was there and I know that. Mo. Otporaš.) the jury in Federal District Court yesterday afternoon found four defendants guilty on counts of racketeering and conspiracy for the purpose of racketeering. Two others were found guilty on one count each of conspiracy, while the remaining four were acquitted.
The prosecution was led by Stuart J. Baskin, who also prosecuted last year’s case, and Paul L. Shechtman. They argued that the group had carried out murders, bombings and arson attacks against political opponents in this country. The attacks, they assessed, were directed from a headquarters in Chicago with branches in New York, Los Angeles, San Francisco and other cities.
The prosecutors also accused the group of having run a scheme to extort money from fellow Croatian exiles in this country to finance their extremist cause, victimizing those who refused to pay and declaring “war on almost every moderate Croatian group.”
Four of the defendants were from the Chicago area, and three of those were four guilty on both counts. They are 37 year old Ante Ljubas, whom the prosecution had described as ” the field general oh this organization”; Mile Markich, and Milan Bagaric.
According to the prosecutors , Mr. Markich was the “elder statesman” of Otpor, also called Croatian National Resistance, an organization with about 300 members. Otpor was not charged with any crime. (I am going to bold this: OTPOR WAS NOT CHARGED WITH ANY CRIME. Mo. Otporaš.)
The fourt Chicagoan, Ivan Misetic, was acquitted. Also acquitted the only defendant from the New York area, Andjelko Jakić of Mamaroneck, N.Y. He had been accused of running an operation here that plotted murders and received weapons.
The two other men found not guilty were from California, Mile Boban of Hillsborough and Miro Biosic of San Clemente. A fellow Californian, Ranko Primorac of Long Beach, was found guilty on both counts.
Acquitted of racketeering charges but found guilty of conspiracy was Vinko Lograrusic of Cleveland. The 10th defendant, Drago Sudar of Toronto, also was convicted of conspiracy, the prosecution having dropped the second count since the original indictment last June.
Each of the counts carries a maximum prison term of 20 years. Judge Constance Beker Montley, was presided at the trial, scheduled sentencing for June 30.
